NOTICE OF SALE UNDER POWER GEORGIA, DOUGLAS COUNTY By virtue of the Power of Sale contained in the Deed to Secure Debt and Security Agreement ("Security Deed") from Donald R. Acker and Avery A. Acker ("Grantor") to the Georgia’s Own Credit Union ("Grantee"), dated December 22, 2014, recorded January 6, 2015 in Deed Book 3267, Page 1038, Douglas County, Georgia Records, said Security Deed being given to secure a Note of even date in the original principal amount of Sixty Six Thousand and 00/100 Dollars ($66,000.00), with interest from date at the rate as provided therein on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Douglas County, Georgia, within the legal hours of sale on the first Tuesday in January, 2018. All that tract or parcel of land lying and being in Land Lot 217 of the 2nd District and 5th Section of Douglas County, Georgia, and being more particularly described as follows: TO FIND THE POINT OF BEGINNING, commence at the intersection of the Southeasterly right-of-way of Governor’s Lane and the Southwesterly right-of-way of Independence Drive; thence running Southwesterly and Northwesterly along the Southeasterly and Southwesterly right-of-way of Governor’s Lane, following the curvature thereof, for a distance of 593.27 feet to an iron pin located at the POINT OF BEGINNING; thence running South 60 degrees, 53 minutes, 06 seconds West for a distance of 452.23 feet to an iron pin; thence running North 41 degrees, 07 minutes, 00 seconds West for a distance of 64.92 feet to an iron pin; thence running North 01 degrees, 16 minutes, 13 seconds West for a distance of 41.68 feet to an iron pin ; thence running North 60 degrees, 53 minutes, 06 seconds East for a distance of 445.92 feet to an iron pin located on the Southwesterly right-of-way of Governor’s Lane; thence running South 29 degrees, 06 minutes, 50 seconds East along the Southwesterly right-of-way of Governor’s Lane for a distance of 100.00 feet to the POINT OF BEGINNING. Said tract of land being more fully shown as Lot 120 of Governor’s Ridge, Unit One on that plat of survey, dated June 3, 1992 and revised November 24, 1992 prepared for Donald R. Acker by Richard E. Nutt, Georgia Registered Land Surveyor No. 1797. Said plat of survey is incorporated in the description herein by reference thereto. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to comply with the terms of the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees. To the best knowledge and belief of Grantee, the above described property is in the possession of Donald R. Acker and Avery A.
