STATE OF GEORGIA COUNTY OF DOUGLAS NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Melanie Black (Parcel I) and Jimmy S. Mayhue and Melanie B. Mayhue (Parcel II) to American General Financial Services, Inc. dated December 20, 2007, and recorded in Deed Book 2654, Page 707, as last modified in Deed Book 2866, Page 253, and pursuant to court order recorded in Deed Book 3501, Page 565, Douglas County Records, said Security Deed having been last sold, assigned, transferred and conveyed to U.S. BANK NATIONAL ASSOCIATION, AS INDENTURE TRUSTEE, FOR CIM TRUST 2016-5, MORTGAGE-BACKED NOTES, SERIES 2016-5, securing a Note in the original principal amount of $132,778.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, November 7, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: Parcel 1: All that tract or parcel of land, together with improvements thereon, situate, lying, and being in Land Lot 218 of the 18th District, 2nd Section, Douglas County, Georgia, and being more particularly described as follows: Beginning at an iron pin located on the Westerly land lot line of Land Lot 218, which said iron pin is North 0 degrees 50 minutes 11 seconds East a distance of 244.5 feet from the southwesterly corner of Land Lot 218: continuing thence North 0 degrees 50 minutes 11 seconds East and along the westerly land lot line of Land Lot 218 a distance of 811.2 feet to an iron pin; proceeding thence North 20 degrees 12 minutes 29 seconds East a distance of 197.1 feet to an iron pin located on the southwesterly edge of the right of way of Brownsville Road; proceeding thence in a southeasterly direction and along the southwesterly edge of the right of way of Brownsville Road, and following a curvature thereof a distance of 772.75 feet to a point: proceeding thence South 37 degrees 52 minutes 14 seconds West a distance of 612.71 feet to an iron pin; proceeding thence North 68 degrees 23 minutes 30 seconds West a distance of 213.4 feet to an iron pin at the Point of Beginning; said parcel containing 8.0 acres. Parcel 2: All that tract or parcel of land, together with improvements thereon situate, lying and being in Land Lot 218 of the 18th District, 2nd Section, Douglas County, Georgia, and being Lot #2 on the Plat of survey prepared for Dianne Black by Carl A. Cochran Surveyors, Inc., dated January 9, 1981, and thereafter revised on February 21, 1981, which said plat is incorporated herein by reference thereto in order to more fully shown the courses and distances, metes and bounds of the described premises. The property is more particularly described as follows: Beginning at an iron pin located on the southwesterly edge of the right of way of Brownsville Road, which said iron pin is 310 feet northwest, as measured along with southwesterly edge of the right of way of Brownsville Road, from the intersection of the southwesterly edge of the right of way of Brownsville Road with the northwesterly edge of the right of way of Old Douglasville Road; proceeding thence South 40 degrees 50 minutes 27 seconds West a distance of 455 feet to an iron pin; thence North 68 degrees 23 minutes 30 seconds West a distance of 235 feet to an iron pin; thence North 37 degrees 52 minutes 14 seconds East a distance of 612.71 feet to a point located on the southwesterly edge of the right of way of Brownsville Road; thence along the southwesterly edge of the right of way of Brownsville Road, and following the curve to the right, a distance of 124.9 feet to a point, which said point is South 33 degrees 49 minutes 56 seconds East a distance of 125 feet from the previously described point; thence South 29 degrees 55 minutes 33 seconds East and along the southwesterly edge of the right of way of Brownsville Road a distance of 141.05 feet to an iron pin and the point of beginning. (sic - And all that tract or parcel of land lying and being in Land Lot 218 of the 18th District and 2nd Section of Douglas County, Georgia, and being more fully shown on plat of same as a 0.368 acre tract of land per survey by Carl A. Cochran, RLS, dated December 29, 1993, and recorded in Plat Book 20, Page 228, record of the Clerk of Superior Court of Douglas County, Georgia, said plat being incorporated herein by reference thereto.) Said property is known as 6229 Brownsville Rd, Lithia Springs, GA 30122, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor. The property is or may be in the possession of Jimmy S. Mayhue, Melanie B. Mayhue and Melanie Black, successor in interest or tenant(s).
