Notice of Sale Under Power Douglas County, Georgia Under and by virtue of the Power of Sale contained in that certain Security Deed given by William C. Couey and Tina B. Allums (collectively, “Grantor”) to Regions Bank (“Lender”), dated October 26, 2011 and recorded November 1, 2011 in Deed Book 2971, Page 160, Douglas County, Georgia official records (the “Security Deed”), conveying the property described below to secure repayment of (i) that certain Promissory Note dated October 26, 2011, payable by Crescent Park Enterprises, Inc. (“Borrower”) to Lender in the principal amount of $500,000.00, together with interest thereon as set forth therein; and (ii) any and all other indebtedness owed by Grantor or Borrower to Lender whether now or hereafter existing (including any amendment, extension, modification, and renewal of any debt instrument evidencing same, the “Secured Indebtedness”), there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Douglas County, Georgia, within the legal hours of sale on the first Tuesday in June 2017 (being June 6, 2017) the following described property located in Douglas County, Georgia, together with all improvements, personalty, fixtures, easements, hereditaments, rights, members, and appurtenances located thereon and described in the Security Deed (collectively, the “Property”): ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 82 OF THE 1st DISTRICT, 5th SECTION, DOUGLAS COUNTY, GEORGIA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT AN IRON PIN PLACED ON THE NORTH RIGHT OF WAY OF LONGVIEW DRIVE (60 FOOT RIGHT OF WAY) 308.50 FEET WEST OF THE INTERSECTION OF THE NORTH RIGHT OF WAY OF LONGVIEW DRIVE WITH THE WESTERLY RIGHT OF WAY OF MIDWAY ROAD (80 FOOT RIGHT OF WAY) AS MEASURED ALONG THE NORTH RIGHT OF WAY OF LONGVIEW DRIVE; THENCE RUNNING SOUTH 85 DEGREES 24 MINUTES 41 SECONDS WEST ALONG THE NORTH RIGHT OF WAY OF LONGVIEW DRIVE 406.22 FEET TO AN IRON PIN PLACED; THENCE RUNNING NORTH 04 DEGREES 34 MINUTES 42 SECONDS WEST 393.90 FEET TO AN IRON PIN PLACED; THENCE RUNNING SOUTH 75 DEGREES 00 MINUTES 46 SECONDS EAST 431.06 FEET TO AN IRON PIN PLACED AND WHICH SAID IRON PIN PLACED IS 75 DEGREES 00 MINUTES 46 SECONDS WEST OF THE WESTERLY RIGHT OF WAY OF MIDWAY ROAD; THENCE RUNNING SOUTH 04 DEGREES 35 MINUTES 19 SECONDS EAST 249.47 TO AN IRON PIN PLACED ON THE NORTH RIGHT OF WAY OF LONGVIEW DRIVE AT THE POINT OF BEGINNING. SAID TRACT CONTAINS 3 ACRES, ALL AS WILL MORE CLEARLY BE SHOWN ON PLAT OF SURVEY PREPARED FOR W. CARL COUEY BY CARL A. COCHRAN, REGISTERED SURVEYOR NUMBER 1370, DATED JUNE 4, 1989, SAID PLAT BEING INCORPORATED HEREIN AND MADE A PART HEREOF BY REFERENCE THERETO. The above-described property is real and personal property located at 3844 Longview Drive, Douglassville, Georgia 30135 according to the present system of numbering property in Douglas County, Georgia. The Secured Indebtedness has been and is hereby accelerated and declared due because of, among other possible events of default, failure to pay the Secured Indebtedness as and when due and in the manner provided in the instruments evidencing the Secured Indebtedness and Security Deed. As the Secured Indebtedness remains in default, the sale will be made for purposes of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney’s fees (written notice of intent to collect attorney’s fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Security Deed.
