NOTICE OF SALE UNDER POWER CONTAINED IN SECURITY DEED STATE OF GEORGIA, COUNTY OF Douglas Pursuant to a power of sale contained in a certain security deed executed by Charles C. Davis and Anjanette S. Davis, aka Anjanette B. Davis, hereinafter referred to as Grantor, to MidFirst Bank, a Federally Chartered Savings Assoc. recorded in Deed Book 2250, beginning at page 262, and modified at Deed Book 3290, Page 740, of the deed records of the Clerk of the Superior Court of the aforesaid state and county, and by virtue of a default under the terms of said security deed, and the related note, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is the present holder of said security deed and note secured thereby) will sell at the usual place of conducting Sheriff's sales in said county within the legal hours of sale, to the highest bidder on the first Tuesday in March 2018, all property described in said security deed including but not limited to the following described property: All that certain parcel of land lying and being situated in the County of Douglas, State of GA, to-wit: All that tract or parcel of land lying and being in Land Lot 97 of the 2nd District and 5th Section of Douglas County, Georgia, and being Lot No. 63 of Sugar Creek Subdivision, Unit 2, as shown on plat of said subdivision recorded in the real property records of Douglas County, Georgia, in Plat Book 11, Page 50; said plat being made a part hereof by this reference thereto for a more complete description of the metes and bounds, courses and distances of said property. Tax Map Reference: 0097-025-0171 Being that parcel of land conveyed to Charles C. Davis and Anjanette S. Davis from Grant Jeffrey Nicholson and Melanie Allen Nicholson by that deed dated 12/28/1999 and recorded 12/30/1999 in Deed Book 1302, at Page 0446 of the Douglas County, GA Public Registry. Said legal description being controlling, however, the Property is more commonly known as: 3850 Sugar Creek Drive, Douglasville, GA 30135 Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the property; any assessments, liens, encumbrances, zoning ordinances, restrictions, and all other matters of record superior to the said Security Deed. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
