NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in the certain Deed to Secure Debt from Entertainment Design Group, Inc., Steven L. Guy, and Kimberly Kris Guy (hereinafter the “Grantors”) to CRF Small Business Loan Company, LLC (hereinafter the “Grantee”) dated November 21, 2013, and recorded December 18, 2013, in Deed Book 3188, Page 751 of the records of the Clerk of Superior Court, Douglas County, Georgia Records, originally having been given to secure a Promissory Note executed by Entertainment Design Group, Inc. in the original principal amount of $1,230,000.00, the property described below will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Douglas County, Georgia, within the legal hours of sale on the first Tuesday in JUNE 2018, such property being described in said deed and as follows, to wit: All that tract or parcel of land lying and being in land lot 79 of the 1st district and the 5th section of Douglas County, Georgia, and being more particularly described as follows: to find the point of beginning, commence at the intersection of the easterly edge of the right of way of Prestley Mill Road (50 foot right of way) and the southerly edge of the right of way of Slater Mill Road (50 foot right of way) and proceed thence in a southerly direction along the easterly edge of the right of way of Prestley Mill Road 654.72 feet to an iron pin, said point being the true point of beginning thence south 61 degrees 25 minutes 54 seconds east 254.27 feet to a point at the centerline of a creek; thence along the center line of a creek (the centerline being the property line) the following traverse lines: south 50 degrees 19 minutes 36 seconds west 190.00 feet to a point; thence south 22 degrees 11 minutes 57 seconds west 48.00 feet to a point; thence south 13 degrees 43 minutes 09 seconds west 180.00 feet to a point at the intersection of the centerline of creek with the south line of land lot 79, said district and section; thence south 89 degrees 32 minutes 52 seconds west along the south line of land lot 79, 117.00 feet to a point; thence north 38 degrees 24 minutes 09 seconds west 234.83 feet to a point on the southeasterly edge of the right of way of Prestley Mill Road; thence in a northerly and northeasterly direction along the southeasterly edge of the right of way Prestley Mill Road the following courses and distances: following a curve to the left an arc distance of 142.60 feet to a point (said curve having a radius of 616.674 feet and being subtended by a chord bearing north 44 degrees 58 minutes 11 seconds east a length of 142.28 feet); thence north 38 degrees 20 minutes 43 seconds east 149.75 feet to a point; thence following a curve to the right an arc distance of 80.93 feet to a point (said curve having a radius of 847.472 feet and being subtended by a chord bearing north 41 degrees 04 minutes 53 seconds east a length of 80.90 feet), said point being the true point of beginning. The captioned premises being shown as tract of 2.43485 acres upon a survey for Charles E. Young and Judy S. Young prepared July 7, 1997, by V.T. Hammond, surveyor, which plat of survey by reference thereto incorporated in this description. The debt secured by said Deed to Secure Debt has been and is hereby declared due and payable in full by reason of default under the terms and provisions of said Deed to Secure Debt and the terms of the Notes and Agreements secured thereby and any and all judgments rendered on such agreements. The debt remaining in default, this sale will be made for the purpose of paying the indebtedness and interest thereon, together with any other indebtedness due and owing by any of the Grantors to Grantee CRF Small Business Loan Company, LLC, all expenses of this sale, including attorney’s fees, notice of intent to collect attorney’s fees having been given, perfected or adjudicated. The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: CRF Small Business Loan Company, LLC, 801 Nicollet Mall, Suite 1700W, Minneapolis, Minnesota 55402. Please understand that the secured creditor is not required to negotiate, amend, or modify the terms of the mortgage instrument. Said property will be sold subject to any outstanding ad valorem taxes including taxes which are a lien, but not yet due and payable, any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, deeds to secure debt, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Deed to Secure Debt first set out above. To the best of the knowledge of Grantee, title to said property is vested in the names of Steven L. Guy and Kimberly Kris Guy.
