Under and by virtue of the power of sale contained with that certain Security Deed dated July 1, 2014, from Philip Donald Hastie Jr. to Mortgage Electronic Registration Systems, Inc., as nominee for Prime Lending, a Plains Capital Company , recorded on August 8, 2014 in Deed Book 3235 at Page 67 Douglas County, Georgia records, having been last sold, assigned, transferred and conveyed to Prime Lending, A Plains Capital Company by Assignment and said Security Deed having been given to secure a note dated July 1, 2004, in the amount of $113,900.00, and said Note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Douglas County, Georgia, on June 5, 2018 the following described real property (hereinafter referred to as the "Property"): ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 128 OF THE 2ND DISTRICT, 5TH SECTION OF DOUGLAS COUNTY, GEORGIA, BEING LOT 57 OF CHEROKEE MANOR SUBDIVISION, UNIT TWO, ACCORDING TO PLAT RECORDED IN PLAT BOOK 6, PAGE 200, DOUGLAS COUNTY RECORDS; BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, BEGINNING AT AN IRON PIN ON THE WESTERLY SIDE OF CHEOAH DRIVE, TWO HUNDRED FORTY TWO AND EIGHT TENTHS (242.8) FEET SOUTHERLY AS MEASURED ALONG THE WESTERLY SIDE OF CHEAOH DRIVE, FROM THE SOUTHWEST CORNER OF THE INTERSECTION OF CHEOAH DRIVE AND ASHWOOD WAY; IF SAID CORNER WERE EXTENDED TO FORM AN ANGLE INSTEAD OF A CURVE; SAID POINT OF BEGINNING ALSO BEING AT THE LINE WHICH DIVIDES LOTS 57 AND 58, SAID SUBDIVISION AND PLAT; THENCE RUNNING SOUTHERLY ALONG THE WESTERLY SIDE OF CHEOAH DRIVE, ONE HUNDRED TEN (110) FEET TO AN IRON PIN AT THE LINE WHICH DIVIDES LOTS 56 AND 57, SAID SUBDIVISION PLAT; SAID POINT ALSO BEING EIGHT HUNDRED SIXTY AND THREE TENTHS (860.3) FEET NORTHERLY AS MEASURED ALONG THE WESTERLY SIDE OF CHEOAH DRIVE, FROM THE NORTHWEST CORNER OF THE INTERSECTION OF CHEOAH DRIVE AND ORCHARD PLACE; THENCE WESTERLY ALONG THE LINE WHICH DIVIDES SAID LOTS 56 and 57, TWO HUNDRED AND FIVE THENTH (202.5) FEED TO AN IRON PIN AT THE LINE WHICH DIVIDES SAID LOTS 57 AND 82, SAID SUBDIVISION AND PLAT; THENCE NORTHERLY ALONG THE LINE WHICH DIVIDES THE ABOVE MENTIONED LOTS 57 and 58, THENCE EASTERLY ALONG THE LINES, WHICH DIVIDES SAID LOTS 57 AND 58; TWO HUNDRED TWO AND EIGHT TENTHS (202.8) FEET TO AN IRON PIN ON THE WESTERLY SIDE OF CHEOAH DRIVE AND THE POINT OF BEGINNING. The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is Philip Donald Hastie Jr. The property, being commonly known as 4014 Cheoah Drive, Douglasville, GA, 30135 in Douglas County, will be sold as the property of Philip Donald Hastie Jr., subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
