NOTICE OF POWER OF SALE CONTAINED IN SECURITY DEED STATE OF GEORGIA COUNTY OF DOUGLAS Under and by virtue of the power of sale contained in that certain Security Deed from Cynthia Edwards Langley a/k/a Cynthia Elaine Barrett, Joseph C. Edwards a/k/a Charles Edwards and Timothy Blake Edwards (hereinafter referred to collectively as “Grantor”) to Citizens & Merchants State Bank, dated January 13, 1999, and recorded in Deed Book 1226, Page 636, Douglas County, Georgia records, as last assigned to Synovus Mortgage Corp. by Assignment dated May 6, 2015 and recorded in Deed Book 3313, Page 920, aforesaid records, as reformed by that certain Order Granting Motion for Judgment on Pleadings dated May 23, 2016, in that certain lawsuit styled Synovus Mortgage Corporation, Association, Plaintiff v. Joseph C. Edwards a/k/a Charles Edwards et al., Defendants, Civil Action File No. 15CV02206, Superior Court of Douglas County, State of Georgia, and recorded in Deed Book 3398, Page 725, aforesaid records, as reformed by that certain Order dated May 23, 2016, in that certain lawsuit styled Synovus Mortgage Corporation, Plaintiff v. Joseph C. Edwards a/k/a Charles Edwards et al., Defendants, Civil Action File No. 15CV02206, Superior Court of Douglas County, State of Georgia, and recorded in Deed Book 3402, Page 458, aforesaid records(hereinafter referred to as the “Security Deed”), Synovus Mortgage Corporation, the present holder of the Promissory Note and Security Deed defined herein, (hereinafter referred to as the “Secured Creditor”), as attorney in fact for Grantor, will sell at public outcry to the highest and best bidder for cash between the legal hours of sale before the courthouse door of Douglas County, Georgia on the first Tuesday in October, 2016, October 4, 2016, the following described property (the “Property”), to-wit: All that tract and parcel of land lying and being in Land Lot 846 of the 18th District, 2nd Section, Douglas County, Georgia, being 0.826 acres, more or less, and being more particularly described as follows: To locate the true point of beginning, commence at a ½ inch rebar found at the intersection of the northern right of way line of East County Line Road (having an 80 foot right of way) with the eastern Land Lot line of Land Lot 846; from said point of intersection run along the northern right of way line of East County Line Road North 88 degrees 24 minutes 00 seconds West a distance of 181.60 feet to a ½ inch rebar found and the true point of beginning. From said point of beginning continue along said right of way line North 88 degrees 24 minutes 00 degrees West a distance of 125.10 feet to a point; thence continuing along said right of way line North 87 degrees 19 minutes 57 seconds West a distance of 74.75 feet to a 5/8 inch rebar set; thence turning and running North 00 degrees 12 minutes 00 seconds West a distance of 180.20 feet to a 5/8 inch rebar found; thence turning and running South 87 degrees 39 minutes 30 seconds East a distance of 200.00 feet to a 5/8 inch rebar set; thence turning and running south 00 degrees 10 minutes 00 seconds East a distance of 179.00 feet to a ½ inch rebar found and the point of beginning, all as more clearly shown on that certain survey prepared by Armstrong Land Surveying, Inc., dated November 14, 1996. Said Security Deed secures that certain promissory note dated January 13, 1999 made by Joseph C. Edwards in favor of Secured Creditor in the original principal amount of Eighty Two Thousand Five Hundred and 00/100ths Dollars ($82,500.00) (hereinafter referred to as the “Promissory Note”), with interest thereon. The indebtedness arising from the Promissory Note has been and is hereby declared due because of default under the terms of the Promissory Note, including, but not limited to the nonpayment of principal and interest when due. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale, and all other payments provided for under the Promissory Note and Security Deed, including attorney’s fees as provided in the Promissory Note and Security Deed, notice of intention to collect attorney’s fees having been given as provided by law; and the remainder, if any, shall be applied as provided by law. The following information is being provided in accordance with OCGA § 44-14-162.2. Synovus Bank is the Secured Creditor under the Security Deed and loan being foreclosed. The following entity shall have full authority to negotiate, amend, and modify all terms of the above-described Security Deed and associated notes on behalf of the Secured Creditor: Synovus Mortgage Corp., 2204 Lakeshore Drive, Suite 325, Birmingham, Alabama, 35209, Telephone No.: (205) 874-1371, Attn: Foreclosures. OCGA § 44-14-162.2 states in pertinent part that, "nothing in this subsection shall be construed to require a secured creditor to negotiate, amend, or modify the terms of a mortgage instrument." The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) to final confirmation and audit of the status of the loan with the holder of said Security Deed. Said property will be sold subject to all liens, encumbrances, unpaid real estate ad valorem taxes and governmental assessments and to all prior restrictions, rights‑of-way, and easements of record, if any, appearing of record prior to the date of the Security Deed and those appearing after the date of the Security Deed and consented to by the Secured Creditor. To the best knowledge and belief of the undersigned, the party in possession of the Property is Cynthia Edwards Langley a/k/a Cynthia Elaine Barrett, Joseph C.
