STATE OF GEORGIA COUNTY OF HENRY NOTICE OF SALE UNDER POWER By virtue of the Power of Sale contained in a Deed to Secure Debt from Deanel Rolle to Kenneth Mordi dated June 20, 2011, and recorded August 12, 2011, in Deed Book 2953, beginning at Pages 830-832, Douglas County Deed Records, said Deed to Secure Debt securing a Promissory Note from Deanel Rolle to Kenneth Mordi, in the original principal amount of $22,000.00, the following described property will be sold at public outcry to the highest bidder for cash before the courthouse door of Douglas County, Georgia, within the legal hours of sale on the first Tuesday in August, 2018: All that tract and parcel of land lying and being in Land Lot 27 of the 1st District and 5th Section of Douglas County, Georgia, and Lot No. 147 of Reynolds Estates Subdivision, Unit Two, as shown by plat of said subdivision recorded in the real property records of Douglas County, Georgia, in Plat Book 7, Page 11; said plat being made a part hereof by this reference thereto, for a more complete description of the metes and bounds, course and distances of said property. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) the right of redemption of any taxing authority, (c) any matters which might be disclosed by an accurate survey and inspection of the property, and (d) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
