NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF DOUGLAS Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Ralph Jeffrey Morris a/k/a Ralph J. Morris a/k/a Jeff Morris and Anita Lynn Morris (“Grantors”), to and in favor of Douglas County Bank n/k/a Hamilton State Bank (“Lender”), dated June 29, 2007 and recorded in Deed Book 2586, Page 219, Douglas County, Georgia as last modified b y that Modification of Deed to Secure Debt, dated November 19, 2015, recorded in Deed Book 3352, Page 9 aforesaid Georgia records (collectively, the “Security Deed”), securing that certain Promissory Note and Commercial Loan Agreement, dated November 19, 2015, in the original principal amount of $243,201.56 ( the “Note”); there will be sold at public outcry by Lender as attorney-in-fact of Grantors to the highest bidder for cash between the legal hours for sale before the Courthouse door in Douglas County, Georgia, on the first Wednesday in July, 2017, due a Federal holiday falling on the first Tuesday of July, 2017 the following described property (the “Premises”) to wit: All that tract or parcel of land lying and being in Land Lot 190 of the 2nd District and 5th Section of Douglas County, Georgia, and being more particularly described as follows: Beginning at a point marked by an iron pin located on the easterly side of Bright Star Road, said point being 1052.19 feet northerly of the intersection of the easterly side of Bright Star Road and the southerly land lot line of Land Lot No. 190 (same being the northerly land lot line of Land Lot 163), as measured along the easterly side of Bright Star Road; running thence north 10 degrees 56 minutes 55 seconds east and along the easterly side of Bright Star Road, a distance of 85.0 feet to a point and corner; running thence south 79 degrees 01 minute 53 seconds east a distance of 247.0 feet to a point marked by an iron pin; running thence south 07 degrees 14 minutes 58 seconds east a distance of 89.46 feet to a point marked by an iron pin; running thence north 79 degrees 02 minutes 11 seconds west a distance of 274.94 feet to a point marked by an iron pin located on the easterly side of Bright Star Road, same being the point of beginning; being all as shown upon that plat of survey prepared by Pounds & Associates, Inc., Registered Land Surveyor for Charles Dodson, dated January 26, 1983, said plat being made a part hereof by this reference thereto. AND: All that tract or parcel of land lying and being in Land Lots 88 and 105 of the 2nd District, 5th Section, Douglas County, Georgia, being more particularly described as follows: Beginning at an iron pin placed on the northerly right of way of Pool Road (50' right of way) said iron pin being located at the point of intersection of the westerly land lot line of Land Lot 88 and the northerly right of way of Pool Road; thence along the westerly land lot line of Land Lot 88, north 0035'04" east a distance of 386.16' to an iron pin found at the common corner of Land Lots 87, 88, 105 and 106; thence along the westerly land lot line of Land Lot 105, north 0015'39" east a distance of 727.12' to an iron pin found; thence continuing along the westerly land lot line of Land Lot 105, north 0011'15" east a distance of 293.13' to an iron pin placed; thence south 8948'09" east a distance of 520.20' to an iron pin placed; thence south 0011'51" west a distance of 509.04' to an iron pin placed; thence proceeding along the centerline of a creek the following courses and distances: south 2440'27" east a distance of 48.48'; thence south 1435'36" west a distance of 76.25'; thence south 1023'29" west a distance of 122.32'; thence south 2016'56" west a distance of 42.57' to an iron pin placed; thence south 0940'52' west a distance of 546.74' to an iron pin placed on the northerly right of way of Pool Road; thence along the northerly right of way of Pool Road the following courses and distances: south 8330'18" west a distance of 120.83'; south 8521'30" west a distance of 104.44'; south 8741'10" west a distance of 101.44'; north 8839'47" west a distance of 73.29' to the point of beginning; being 15.02 acres, all as is more particularly shown on that plat of survey for Ralph J. Morris and Anita Lynn Boatright, dated May 20, 1988, prepared by Timothy L. McGukin, said plat of survey being incorporated herein by reference to more clearly show the courses, metes, bounds and distances. LESS AND EXCEPT: All that tract or parcel of land lying and being in Land Lots 88 and 105 of the 2nd District, 5th Section of Douglas County, Georgia, and being more particularly described as follows: Begin at an iron pin located at the intersection of the northerly edge of the 50 foot right of way of Pool Road with the west land lot line of Land Lot 88; thence north 0035'04" east a distance of 386.16 feet along the west land lot line of Land Lot 88 to an iron pin found at the northwest corner of Land Lot 88; thence north 0015'39" east a distance of 727.12 feet along the west land lot line of Land Lot 105 to an iron pin; thence north 0011'51" east a distance of 239.13 feet along the west land lot line of Land Lot 105 to an iron pin; thence south 8948'09" east a distance of 162.00 feet to a point; thence south 0020'47" west a distance of 1349.98 feet to an iron pin located on the northerly edge of the 50 foot right of way of Pool Road; thence south 8741'10" west a distance of 88.71 feet along the northerly edge of the right of way of Pool Road to a point; thence north 8839'47" west a distance of 73.29 feet along the northerly edge of the right of way of Pool Road to its intersection with the west land lot line of Land Lot 88 and the true point of beginning. The above described tract of land is designated as Tract No. 2, containing 5.00 acres, upon that plat of survey prepared for Lyn B. Morris by Timothy L. McGukin, Registered Georgia Land Surveyor No. 2289, dated May 20, 1988, as revised March 4, 1992, which plat by this reference thereto is incorporated herein for a more complete description of the property. FURTHER LESS AND EXCEPT that property, if any, released of record; The indebtedness evidenced by the Note is due and payable and remains unpaid. The Security Deed therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Security Deed. The Premises will be sold on an “as is, where is” basis without recourse against Lender and without representation or warranty of any kind or nature whatsoever by Lender with respect thereto. The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorneys’ fees (notice of intention to collect attorneys’ fees having been given), then to the payment of all sums secured by the Security Deed, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Note and Security Deed. The Premises shall be sold as the property of Grantor, subject to all restrictions, easements and other matters of record that are prior to the Security Deed and to which the Security Deed is subject and to any unpaid city, county and state ad valorem taxes or assessments relating to the Premises. To the best knowledge and belief of the undersigned, the party in possession of the Premises is Grantors, Ralph Jeffrey Morris a/k/a Ralph J. Morris a/k/a Jeff Morris and Anita Lynn Morris or a tenant or tenants and said property is more commonly known as 8830 Bright Star Road, Douglasville, Georgia 30134 and 10.02 acres on Pool Road, Winston, Georgia 30187.
