STATE OF GEORGIA COUNTY OF DOUGLAS NOTICE OF SALE UNDER POWER Because of default in the payment of the indebtedness secured by the security deed executed by CLAUDE BARRY CHANDLER, JR. AND TANIA MARIA CARRANZA-CALVO to BRENDA ELLIOTT on November 15, 2013, and recorded in Deed Book 3181, Page 964, Douglas County, Georgia Records, as modified by Modification Agreement dated January 15, 2017, and recorded in Deed Book 3464, Page 788, Douglas County, Georgia records, BRENDA ELLIOTT, as lender, pursuant to the security deed and the secured note, has declared the entire amount of said indebtedness due and payable and, pursuant to the Power of Sale contained in the security deed, will on the first Tuesday in November, 2017, during the legal hours of sale, at the courthouse door in Douglas County, Georgia, sell at public outcry to the highest and best bidder for cash, the following described property: ALL THAT TRACT or parcel of land lying and being in Land Lot 22 of the 1st District and 5th Section of Douglas County, Georgia, and being more particularly described as follows: BEGINNING AT A POINT on the original South line of Land Lot 22, which point is a distance of 661.79 feet East from the original Southwest corner of Land Lot 22, and running thence North 88 degrees 4 minutes East a distance of 461 feet; thence North 2 degrees 20 minutes West a distance of 312.2 feet; thence North 2 degrees 20 minutes West a distance of 125 feet; thence South 88 degrees West a distance of 198.4 feet; thence South 82 degrees 26 minutes West a distance of 306.3 feet and to a corner in the center of a creek or branch; thence Southeasterly and Southerly and along the center of said creek or branch and following the meanderings thereof a distance of 430 feet more or less, to the point of beginning. To the best knowledge and belief of the lender, the party in possession of the property is CLAUDE BARRY CHANDLER, JR. AND TANIA MARIA CARRANZA-CALVO or a tenant or tenants, and the property is more commonly known as 9064 Myrtle Drive, Douglasville, GA 30134. The property will be conveyed subject to (i) any unpaid property taxes which may be liens against the property; and (ii) all easements and restrictions of record, if any, having priority over the security deed. The sale will be held subject to (i) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (ii) final confirmation and audit of the status of the loan with the holder of the security deed. This property is sold AS IS and WHERE IS and without representation or warranty, and without recourse against Lender. The property will be sold as the property of CLAUDE BARRY CHANDLER, JR. AND TANIA MARIA CARRANZA-CALVO and the proceeds of sale will be applied to the payment of all indebtedness secured by the security deed, the expense of sale, all as provided in the security deed, and lender will execute a deed to the purchaser as provided in the security deed.
