STATE OF GEORGIA, COUNTY OF DOUGLAS NOTICE OF SALE UNDER POWER IN SECURITY DEED By virtue of the power of sale contained in a Deed to Secure Debt dated September 27, 2012 from Cinderella Nwakanma to Henry L. Hawkins in the original principal amount of $116,395.00 recorded at Deed Book 3063, Page 304, Douglas County, Georgia records, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door of Douglas County, Georgia, during the legal hours of sale on the first Wednesday in July, 2017, property known as 6501 Church Street a/k/a 6501 E. Church Street, Douglas County, Georgia, being more particularly described as follows: ALL THAT TRACT or parcel of land lying and being in Land Lot 20 of the 1st District and the 5th Section of Douglas County, Georgia, and being more particularly described as follows: Tract One: BEGINNING at a point located on the northerly side of East Church Street, said point being 60.0 feet westerly from the intersection of the northerly side of East Church Street and the westerly side of James Street, as measured along the northerly side of East Church Street; running thence in a westerly direction and along the northerly side of East Church Street; running thence in a westerly direction and along the northerly side of East Church Street a distance of 97.0 feet to a point and corner; running thence in a northerly direction and parallel with the westerly side of James Street a distance of 100 feet to a point and corner; running thence in a easterly direction and parallel with the westerly side of James Street a distance of 100.00 feet to a point and corner, running thence in an easterly direction and parallel with the northerly side of East Church Street a distance of 97.0 feet to a point and corner; running thence in a southerly direction and parallel with the westerly side of James Street a distance of 100.00 feet to a point located on the northerly side of East Church Street, same being the point of beginning; this being the same property conveyed by Warranty Deed dated January 28, 1956 and recorded in the real property records of Douglas County, Georgia, in Deed Book 34, page 329. Tract Two: All that tract and parcel of land lying and being in Land Lot 20 of the 1st District and 5th Section of Douglas County, Georgia, and being more particularly described as follows: BEGINNING at a point located at the intersection of the northerly side of East Church Street and the westerly side of James Street; running thence in a westerly direction and along the northerly direction and parallel with the westerly side of James Street a distance of 100.00 feet to a point; running thence in an easterly direction and parallel with the northerly side of East Church Street a distance of 65.00 feet to a point and corner located on the westerly side of James Street; running thence in a southerly direction and along the westerly side of James Street a distance of 100.0 feet to a point located at the intersection of the westerly side of James Street and the northerly side of East Church Street, same being the point of beginning; same being known as Lot No. 18 of Block No. 3, Douglas Hosiery Mills Property, as shown by plat thereof recorded in the real property records of Douglas County, Georgia, in Plat Book 1, Page 100 (said plat being made a part hereof by this reference thereto); and being the same real property conveyed by warranty deed dated April 20, 1971 and recorded in real property records of Douglas County, Georgia, in Deed Book 157, Page 17. Said property is known as 6501 E. Church Street a/k/a 6501 Church Street, Douglasville, GA, together with all fixtures and personal property attached to and constituting a part of said property, if any. The debt secured by said instrument having been declared due because of default in payment, this sale will be made for the purpose of paying said debts and all expenses of this sale, including attorneys’ fees, notice having been given. This property will be sold as the property of Cinderella Nwakanma subject to any outstanding taxes, easements, assessments and restrictions of record, if any, having priority over this Deed to Secure Debt. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. § 44-14-162.2, the name, address and telephone number of the individual or entity who shall have the full authority to negotiate, amend or modify all terms of the above described Deed to Secure Debt is as follows: Henry L. Hawkins, 8619 Foxridge Drive, Winston, Georgia 30187, Telephone number (404) 291-2928. The foregoing notwithstanding, nothing in O.C.G.A. § 44-14-162.2 shall be construed to require Henry L. Hawkins to negotiate, amend, or modify the terms of the Deed to Secure Debt described herein. Henry L. Hawkins as attorney-in-fact for Cinderella Nwakanma. This is an attempt to collect a debt.
