STATE OF GEORGIA, COUNTY OF DOUGLAS NOTICE OF SALE UNDER POWER IN SECURITY DEED Because of a default in the payment of the indebtedness secured by a Security Deed executed by ANNETTA D. STEMBRIDGE to 3845 WILLOWBROOK, LLC dated December 20, 2011, and recorded in Deed Book 3116, Page 331, Douglas County, Georgia records, modified by Modification Agreement executed by ANNETTA D. STEMBRIDGE to 3845 WILLOWBROOK, LLC dated July 31, 2015 and recorded in Deed Book 3316, Page 557, securing a Note in the original principal amount of $23,936.87, the holder thereof pursuant to said Security Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable pursuant to the power of sale contained in said Security Deed, will on April 3, 2018, during the legal hours of sale, before the Courthouse door in said county, sell at public outcry to the highest bidder for case, the property described in said Deed, to wit: Tract One: ALL THAT TRACT or parcel of land lying and being in Land Lot 153 of the 2nd District, 5th Section, of Douglas County, Georgia, and more particularly described as follows: BEGINNING at a point on the South side of the right of way of “152” Road a/k/a Richardson Road, 412.3 feet West from the point of intersection of the South side of the right of way of said road and the West side of the right of way of Mason Creek Road, run thence South 85 degrees 01 minutes West along the South side of said road of said right of way 90 feet to an iron pin corner; run thence South 03 degrees 11 minutes East 240.85 feet to an iron pin corner; run thence South 63 degrees East 103.77 feet to an iron pin corner; run thence North 03 degrees 11 minutes West 295.85 feet to the point of beginning. All as will more fully appear by plat of survey of the same for Bobby Stembridge by Wyman C. Hudson, Surveyor, dated April 1, 1978 and said plat is by reference thereto made a part hereof and incorporated herein to more fully show the courses, distances, metes and bounds of the lands herein conveyed. Tract Two: ALL THAT TRACT or parcel of land lying and being in Land Lot 153 of the 2nd District, 5th Section of Douglas County, Georgia and being more particularly described as follows: BEGINNING at a point on the South side of the right of way of “152” Road a/k/a Richardson Road, 412.3 feet West from the point of intersection of the South side of the right of way of said road and the West side of the right of way of Mason Creek Road; running thence South 03 degrees 11 minutes East for a distance of 295.85 feet to an iron pin (said line being and intended to be that same line which constitutes the eastern boundary of the property conveyed by Nobbie Morgan Moore to Bobby E. Stembridge and Annetta Stembridge by Warranty Deed dated August 4, 1978); running thence North 0 degrees 16 minutes West a distance of 86.48 feet to an iron pin; running thence North 08 degrees 31 minutes East a distance of 216.04 feet to an iron pin on the Southside of the right of way of “152” Road; thence running westerly along the said South right of way of said “152” Road a distance of 48.0 feet to an iron pin and the point of beginning. All as shown on that certain plat of property of Bobby Stembridge made by Wyman C. Hudson on August 12, 1978, and revised on November 6, 1978. The parcel of land herein conveyed being a generally triangular shaped piece of property lying immediately adjacent to the East side of that property conveyed by Nobbie Morgan Moore to Bobby E. Stembridge and Annetta Stembridge by Warranty Deed dated August 4, 1978. Said property commonly known as 7721 Conners Road, Winston, Georgia. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Security Deed. Said property will be sold as the property of Annetta D. Stembridge. The property, to the best information, knowledge and belief of the undersigned, is presently in the possession of Annetta D. Stembridge, and the proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale, including attorney’s fees, all as provided in said Security Deed, and the balance, if any will be distributed as provided by law.
