STATE OF GEORGIA, COUNTY OF DOUGLAS NOTICE OF SALE UNDER POWER IN SECURITY DEED By virtue of the power of sale contained in a Deed to Secure Debt dated February 18, 2016, from Christopher Thomas to Charles C. Harden and Kathryn D. Harden in the original principal amount of $60,500.00, recorded at Deed Book 3364, Pages 815-819, Douglas County, Georgia records, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door of Douglas County, Georgia, during the legal hours of sale on the first Tuesday in October, 2016, property known as 3319 Brookmont Parkway, Douglas County, Georgia, being more particularly described as follows: ALL THAT TRACT or parcel of land lying and being in Land Lots 76 and 86 of the 1st District and 5th Section of Douglas County, Georgia and being more fully shown as a 12.2 acre tract of land per survey for Dennis E. Mobley, Jr., James Scott McGarva and Terry Michael Roberts by Carl A. Cochran Surveyors, RLS No. 1370, dated September 25, 2002 and being recorded in Plat Book 29, Page 171, Douglas County, Georgia records. Said Plat being incorporated herein by reference thereto. The debt secured by said instrument having been declared due because of default in payment, this sale will be made for the purpose of paying said debts and all expenses of this sale, including attorneys’ fees, notice having been given. This property will be sold as the property of Christopher C. Thomas subject to any outstanding taxes, easements, assessments and restrictions of record, if any, having priority over this Deed to Secure Debt. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. § 44-14-162.2, the name, address and telephone number of the individual or entity who shall have the full authority to negotiate, amend or modify all terms of the above described Deed to Secure Debt is as follows: Charles Harden, Telephone number 770-479-1765. The foregoing notwithstanding, nothing in O.C.G.A. § 44-14-162.2 shall be construed to require Charles Harden to negotiate, amend, or modify the terms of the Deed to Secure Debt described herein.
