The issue of Sunday alcohol sales at farm wineries and other places in unincorporated Carroll County will come before the Board of Commissioners for consideration at its Feb. 6 meeting.

County Attorney Stacey Blackmon is scheduled to make a presentation on a resolution for a referendum of Sunday alcohol sales and another resolution for Sunday sales at farm wineries.

The last time the issue came before the Board of Commissioners was in August 2016 when it voted to not include Sunday alcohol sales on the November ballot.

At the time, the community was divided on the matter with some residents saying they were for the sales, especially at wineries, tourist attractions that are missing out on attracting visitors because they can’t sell on Sundays. Churches opposing Sunday sales invited their congregations to speak out against it and were happy when commissioners shot down the consideration.

Blackmon will present a resolution authorizing a referendum to allow by the drink sales on Sundays by licensed retailers of malt beverages, wine, and distilled liquor, and a referendum to allow package sales on Sundays by retailers of malt beverages and wine.

Sales of malt beverages, wine and distilled liquor by licensed retailers are currently allowed Mondays through Saturdays in the unincorporated area of the county.

The referendum will allow sales to take place on Sundays between the hours of 12:30 p.m. to midnight in licensed establishments that derive at least 50 percent of its total annual gross sales from the sale of prepared meals or food in all of the combined retail outlets of the individual establishment where food is served and in any licensed establishment that derives at least 50 percent of its total annual gross income from the rental rooms for overnight lodging.

If approved by the Board of Commissioners, the referendum would be placed on the May 22 ballot.

With regard to the resolution for Sunday sales at farm wineries, this consideration would amend the current ordinances to provide for the regulation of sale wine in a tasting room or other farm winery facility on Sundays.

Pursuant to ordinances 6-197 and 6-198, the sale of wine in a tasting room or other licensed farm winery facility is currently permitted and regulated on Mondays through Saturdays in Carroll County.

Ordinance 6-197 of Article XIII prohibits Sunday sales while Ordinance 6-198(g) of Article XIII regarding will be amended from “No Sales” and to sales on Sunday between the hours of 12:30 p.m. to 12 a.m.
