Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by IRVIN GIBSON AND CHRISTINE GIBSON to WACHOVIA BANK, NATIONAL ASSOCIATION , dated 08/12/2005, and Recorded on 08/26/2005 as Book No. 2212 and Page No. 345 351, DOUGLAS County, Georgia records, as last assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY, BUT SOLELY AS TRUSTEE OF CITIGROUP MORTGAGE LOAN TRUST 2019 D (the Secured Creditor), by assignment, conveying the after described property to secure a Note of even date in the original principal amount of $174,772.50, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the DOUGLAS County Courthouse within the legal hours of sale on the first Tuesday in June, 2021, the following described property: ALL THAT CERTAIN PROPERTY SITUATED IN THE CITY OF DOUGLASVILLE IN THE COUNTY OF DOUGLAS AND STATE OF GEORGIA AND BEING DESCRIBED IN A DEED DATED 02/10/1994 AND RECORDED 03/31/1994 IN BOOK 868, PAGE 323 AMONG THE LAND RECORDS OF THE COUNTY AND STATE SET FORTH ABOVE AND REFERENCED FOLLOWS: LAND LOT 135 DISTRICT 1 LOT 36 SECTION 5 OF AMBER CREEK SUBDIVISION IN PLAT BOOK 19 PAGE 263. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
